The project is worth more than IDR 3 trillion. The project is cited as a National Strategic Program.

PT Krakatau Chandra Energi (“KCE”)/ 2024 – Preparation of legal studies related to Plans for Termination of Subcontractor Agreements. KCE is a subcontractor in the construction of the PLTU. KCE requested the preparation of a legal study regarding the Subcontractor Agreement Termination Plan which includes risk identification and mitigation by considering aspects of variation orders, descoping the scope of work, and technical aspects of disbursement of performance guarantees.

Water

SUEZ (Asia Pacific) Limited/ 2025 – Providing legal assistance to SUEZ (Asia Pacific) Limited (“SUEZ”) in connection with its proposed participation in a Public-Private Partnership (PPP) Unsolicited Water Infrastructure Development Project in Indonesia. Our assistance includes a comprehensive review and update of key project documents, including the Build-Operate-Transfer (BOT) and Build-Lease-Transfer (BLT) contracts, to ensure alignment with Indonesian regulatory requirements and international best practices. In addition to transactional support, AHRP also provides strategic legal advisory to SUEZ on the structuring of PPP schemes in the water sector, including risk allocation, government support mechanisms, and compliance with relevant laws and regulations governing unsolicited proposals in Indonesia. Directorate of Drinking Water, Ministry of Public Works and Housing (PUPR), Republic of Indonesia/ 2026 – Legal advisory to the Government Contracting Agency (Directorate General of Human Settlements) during the implementation phase of the Public–Private Partnership (PPP) Agreement for the Jatiluhur I Regional Water Supply Project. The scope of work included ongoing legal coordination and monitoring, compliance review and oversight, assessment of compliance findings arising from internal and external audits, and the preparation of amendments to the PPP agreement, off-taker agreements, and other relevant agreements, as required, to ensure the effective execution of the project in accordance with applicable laws, regulations, and contractual arrangements.

Ministry of Public Works and Public Housing Directorate General of Public Works and Housing Infrastructure Financing/ 2022 – Legal advisor for the Ministry of Public Works and Housing of Republic Indonesia. The legal services provided include conducting the formulation of legal assessments within the preliminary study on irrigation rehabilitation in Colo, Central Java, formulating a concise presentation of the preliminary study for coordination with relevant stakeholders, both externally and internally within the Ministry of Public Works and Housing and giving recommendation regarding suitable KPBU structures based on the project's circumstances, conditions, plans, and best practices in irrigation infrastructure projects. This work is aimed at identifying implementation requirements for the PPP project.

Ministry of Transportation/ 2018 – Preparation of preliminary study of the proposed three national port PPP projects namely Tahuna Port, Tobelo Port, and Namlea Port. The study is addressed to provide thorough legal analysis on legal compliance in the proposed projects to be procured through PPP scheme.

The advisory encompassed an analysis of the proposed regulatory framework, its potential impact on toll-road business entities (BUJT), and strategic recommendations to support effective legislative alignment with Indonesia’s toll-road development.

PT Waskita Toll Road and its subsidiary PT Waskita Transjawa Toll Road/ 2022 – Advising PT Waskita Toll Road and its subsidiary PT Waskita Transjawa Toll Road in the IDR 5.8 trillion toll road divestment project involving Indonesia Investment Authority (“INA”) as the purchaser. This divestment is part of the major loan restructuring deal secured by PT Waskita Karya (Persero), Tbk. (IDX: WSKT) last year and put INA’s participation in the toll road business.

PT Cipta Krida Bahari/ 2025 – Based on a conditional share purchase agreement, the Client is a potential acquirer of a company engaged in port activities. Subsequently, a minority shareholder objected to the acquisition plan, arguing that the shares should have been offered to him first, as he holds the right of first offer. Consequently, the minority shareholder filed a tort lawsuit seeking to annul the conditional share purchase agreement and obtain a legal declaration affirming the validity of the right of first offer.

PT Asuransi Purna Artanugraha/ 2018 – Assisting PT Asuransi Purna Artanugraha in handling cases at the Permanent Court of Arbitration with the Indonesian National Arbitration Board as the appointing authority with a claim value of USD 1 million.

Ministry of Forestry and Environment/ 2019 – The preparation of hazardous waste management facilities in Sumatera and Sulawesi, to be carried out under the PPP scheme.

PT Panca Jasa Lingkungan/ 2021 – Development of waste-water management project in Kendal and Pekanbaru.

Jakarta Environmental Agency/ 2022 – Development of waste management development facility by signing the Design and Build Integrated Construction Works Agreement for Landfill Mining and Refused Derived Fuel Waste Processing Facilities Plant with Adhi-Jaya Konstruksi KSO. Legal experts working collaboratively with construction management consultants in providing legal input and legal considerations in terms of preparation of such agreement. Landfill Mining and Refused Derived Fuel Waste Processing will be constructed in Bantargebang landfill in Bekasi. Bantargebang landfill in Bekasi has been operating since 1989. Bantargebang landfill has accommodated a large amount of waste from Jakarta over the years, where the land area of the Bantargebang landfill is more than 100 hectares. This collaboration between DLH DKI Jakarta and Adhi-Jaya Konstruksi KSO aimed to process waste into more valuable materials and reduce the potential for environmental pollution.

Ministry of Forestry and Environment/ 2022 – Preparing outline business case regarding the Development of Hazardous Waste Treatment in East Kalimantan which includes the identification of needs for implementation of project in PPP scheme.

Shanghai SUS Environment/ 2023 – Acts as the local counsel (together with KWM Law Firm as its international legal consultant) in advising the Client to participate in the procurement of strategic partners organized by PT Jakarta Propertindo (Perseroda) (and its subsidiary, PT Jakarta Solusi Lestari) for one of the Indonesian national strategic project, namely the Intermediate Treatment Facility (ITF) Project in Sunter. The scope of work, among other things, is to provide input in the project agreements (e.g. EPCF contract, project basic agreement, and conditional share subscription agreement), conduct legal due diligence on PT Jakarta Solusi Lestari (in which the Client will provide its equity and debt contribution), and assist in the contract negotiation process.
